1. BUSINESS PROMOTION. Moonstew (”Sponsor”), PO Box 386, DuPont, WA 98327, is offering a chance to win (hereinafter referred to as “Prize”) a check worth $2,011 USD or advertising worth $2,011 USD.
  2. NO PURCHASE, PAYMENT, OBLIGATION OR NEW ACCOUNT IS NECESSARY TO ENTER OR WIN. No disclosure of personal financial information is required in order to enter or win. To enter, mail a recipt showing the purchase of a game product from a game retailer OR a 3×5″ card (both hereinafter referred to as “Entry Form”) with your name, email address, mailing address and phone number to Moonstew Attn: Best of 2011 Contest so that the Entry Form arrives no later than March 15, 2012 in order to be considered for a chance to win a Prize. A Prize will be awarded March 30, 2012.
  3. ENTRY. Entry Forms must be received at PO Box 386, DuPont, WA 98327 no later than March 15, 2012. Entries received after March 15, 2012 will be discarded. A single winner will be selected in a random drawing from eligible entries received. The participant whose qualifying entry is drawn and who timely accepts the prize in accordance with these Official Rules will receive the Prize, subject to the terms and conditions of these Official Rules.
  4. PARTICIPATION CONSTITUTES ACCEPTANCE. Participation in this Business Promotion constitutes entrant’s full and unconditional acceptance of the Official Rules.
  5. ELIGIBILITY. Employees, agents, successors, affiliates and assignees of Sponsor, its advertising agencies and promotional companies involved in the Promotion, as well as immediate family members and household members of the same shall be ineligible to participate in the Promotion. The term “immediate family members” includes spouses, un-married partners, grandparents, parents, siblings, children, and grandchildren (living with employee or not). Giveaway is void where prohibited by law.
  6. ODDS OF WINNING. Odds of winning the Prize depend on the number of entries received during Promotional Period.
  7. WINNER SELECTION. The Prize winner will be chosen by Sponsor from entries received. One winner will be randomly selected from the eligible entries. Prizes are non-transferable. The advertising Prize may not be translated into a cash equivalent.
  8. TAXES. Winners will be responsible for all applicable fees and/or taxes (including any federal, state, or local income taxes) associated with receipt of the Prize. Winner must provide Sponsor with valid identification and valid taxpayer identification number/social security number before any Prize will be awarded. Any person winning over $600 in Prizes will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.
  9. NOTIFICATION FOR PRIZE. Sponsor will notify Prize winner by phone and by U.S. mail within ten (10) days after the winning entry is announced from the eligible entries for the specific Prize. If a potential winner cannot be contacted, declines to accept the Prize, is deemed to be ineligible as determined by these Official Rules, or if a potential winner does not respond to a notification of winning from Sponsor within thirty (30) days after mailing the written notification or thirty (30) days after notification by telephone (whichever is earlier), the Prize shall be considered forfeited. If the participant fails to provide an address on the entry form, no written notification will be made and the winner will be notified by telephone only. A letter confirming the winning Prize as well as outlining applicable additional information, and a copy of the Official Rules and entry blank will be delivered to each winning participant within five (5) days after the winning participant accepts the Prize. The Prize will be delivered to the winning participant, without expense to the participant, within thirty (30) days after acceptance of the Prize.
  10. AFFIDAVIT OF ELIGIBILITY. As a condition of being awarded any Prize, winners may be required to deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and a release of liability.
  11. CONSENT. Acceptance of a Prize constitutes permission by the winner for Sponsor to use the winner’s name, character likeness, photograph, voice, and/or prize information, without limitation, for promotional purposes without further authorization or remuneration. As a condition of being awarded a Prize, except where prohibited by law, a winner may be required to execute consent to the use of their name, likeness, voice and/or Prize information without limitation, for promotional purposes without authorization or remuneration.
  12. GOVERNING LAW. The Official Rules shall be governed, construed and interpreted under the laws of the State of Washington and the United States. Participants agree to be bound by these Official Rules and the decisions of Sponsor as to the interpretation of these Official Rules, which shall be binding in all respects.
  13. CONDUCT, DECISIONS AND WAIVER. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the Official Rules or for acting in an unsportsmanlike or disruptive manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. All decisions will be made by Sponsor and are final. Sponsor may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS GIVEAWAY, OR TELEPHONE SYSTEMS, OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor may substitute Prizes, amend the rules or discontinue the Giveaway at any time.
  14. DISCLAIMER. By entering the Prize drawing, participants assume all liability for any injuries or damages caused or claimed to be caused by their participation in this Prize drawing and/or the acceptance, use and/or misuse of any Prize, and agree to release, discharge and hold harmless Sponsor or other service providers, or any other entity associated with this Giveaway, and each of their respective parents, affiliates, subsidiaries, retailers, agencies and all of their respective officers, directors, shareholders, employees, agents, designees, representatives, successors, and assigns (collectively, the “Released Parties”), from and against any and all claims, actions, liability, injuries and damages, whether direct or indirect, which may be due to or arise out of participation in the Giveaway or any portion thereof, or the acceptance, use/misuse or possession of any Prize. Sponsor disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Sponsor is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind. Entry forms in a register-to-win contest must be handwritten. No photocopies or mechanical reproductions of entry forms are permitted.
  15. DATA PRIVACY. Sponsor will not sell, trade or rent entrant’s personal information to others. Any information entrants provide to Sponsor will be used exclusively to communicate with participants in relation to the Giveaway. Sponsor may also use this information to occasionally contact entrants at a future date about new products and services Sponsor believes entrants will find valuable. Entrants will be given the option if they prefer not to receive any information.
